Terms of Service

Rules and expectations for using the mTikOps platform.

General

These Terms of Use ("Terms") are a binding agreement between you and mTik_Ops ("mTik_Ops," "we," "us," or "our"). By accessing or using mTik_Ops Platform, mTik_Ops Solutions, mTik_Ops Services, related websites, portals, mobile apps, APIs, support channels, and hosted environments (collectively, the "Services"), you agree to these Terms.

Scope of Services

The Services include, as available under your plan and permissions:

  • Workspace operations for ISP/WISP teams (subscriber lifecycle, billing workflows, support/ticketing, logs, team, settings).
  • Network operations modules (MikroTik-connected tools, hotspot services, voucher/sales operations, pool/PON/NAP management, maps/geodata, router-integrated workflows).
  • Finance and billing features (wallet, top-up requests, subscriptions, VPN subscription flows, SOA/invoice automation, payment reminders, tax/VAT settings).
  • Team and people operations (employee/team management, attendance/DTR, leave, payroll operations, approvals, scheduling, analytics).
  • White-label and public-site controls (branding, domain connection, DNS/SSL workflow automation).
  • Admin control plane (users, plans, permissions, guides/content, governance, system settings).
  • Subscriber/client surfaces (client portal, account security, billing history, help center/tickets, profile and authentication endpoints).
  • API and integration surfaces (workspace API tokens/webhooks/logs/IP allowlist, payment/SMS/RADIUS and other supported integrations).
  • Automation workers and background jobs for billing, reminders, renewals, delivery queues, heartbeat/health checks, log retention, and related operational tasks.

Eligibility and Authority

You represent and warrant that:

  • You are legally able to enter into these Terms.
  • If you use the Services on behalf of an entity, you have authority to bind that entity.
  • Information you provide is accurate, complete, and kept current.

Accounts, Authentication, and Security

You are responsible for:

  • All activity under your account and workspace(s), including actions by invited users.
  • Protecting credentials, tokens, sessions, devices, and recovery methods.
  • Promptly notifying us of suspected unauthorized access, credential compromise, or security incidents.

mTik_Ops may enforce security controls including session controls, CSRF protections, role-based access controls, policy checks, rate limiting, audit logs, and account hardening requirements. We may suspend access to protect security, integrity, legal compliance, or platform operations.

Roles, Teams, Employees, and Subscribers

Account owners and administrators are responsible for:

  • Assigning roles and permissions appropriately.
  • Managing team/employee lifecycle status and access.
  • Ensuring workspace users and subscribers are authorized and lawfully managed.

You are responsible for all acts and omissions of your users, employees, team members, contractors, and subscriber accounts using your workspace or tenant.

Subscriptions, Fees, Wallet, and Payments

Paid features require an active subscription, approved agreement, or funded wallet/top-up balance.

  • Pricing, limits, billing cycles, and features are defined by your selected plan, order, invoice, or pricing page.
  • You authorize recurring billing where auto-renew is enabled.
  • Late, failed, reversed, or disputed payments may result in feature restriction, suspension, downgrade, or termination.
  • Unless required by law or expressly stated otherwise, fees are non-refundable.
  • Fees are exclusive of taxes, duties, and government charges, which are your responsibility.
  • Wallet and top-up mechanisms are service credits and not deposit accounts.

Acceptable Use

You agree not to:

  • Use the Services for unlawful, harmful, fraudulent, abusive, or deceptive activity.
  • Attempt unauthorized access, privilege escalation, scraping, probing, or circumvention of security or tenancy boundaries.
  • Disrupt service performance, availability, or other users` operations.
  • Upload malware, exploit code, or content violating law or third-party rights.
  • Misuse APIs, automation workers, integrations, or router/network controls in ways that cause harm, abuse, or unauthorized access.
  • Reverse engineer or misuse proprietary components except where law expressly permits.

Customer Data and Responsibility

You retain ownership of Customer Data you submit to the Services.

You grant mTik_Ops a limited, non-exclusive license to host, process, transmit, cache, back up, and display Customer Data solely to provide, secure, maintain, support, and improve the Services.

You are responsible for:

  • Lawful collection and use of Customer Data.
  • Required notices, legal basis, and consents.
  • Data accuracy, retention, and data subject rights handling in your business context.

We may use aggregated and de-identified data for analytics, reliability, security, and service improvement.

Privacy and Security

Our handling of personal data is governed by the mTik_Ops Privacy Policy.
We implement reasonable technical and organizational safeguards, but no system is completely secure or uninterrupted.

Third-Party Services and Integrations

The Services may interoperate with third-party providers (for example payment, messaging, DNS/SSL, hosting, telecom/network, RADIUS, or other integrations). mTik_Ops is not responsible for third-party products, uptime, security, availability, policies, or acts/omissions.

Intellectual Property

mTik_Ops and its licensors own all rights, title, and interest in the Services, software, documentation, trademarks, branding, and related intellectual property.

Except for limited rights expressly granted in these Terms, no license is granted by implication, estoppel, or otherwise.
Feedback may be used by mTik_Ops without restriction or compensation.

Service Changes, Beta Features, and Availability

mTik_Ops may add, modify, deprecate, or discontinue features at any time.
We do not guarantee uninterrupted or error-free operation.
Planned and emergency maintenance, provider outages, abuse controls, or technical events may affect availability or performance.

Suspension and Termination

We may suspend or terminate access immediately if:

  • You breach these Terms.
  • Payment obligations are unmet.
  • Use creates security, legal, compliance, operational, or abuse risk.
  • Required by law, court order, regulator, or government authority.

Upon termination, your right to use the Services ends. Provisions that should survive (including payment, IP, warranty disclaimer, liability limits, indemnity, and dispute terms) remain effective.

Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.

Limitation of Liability

To the maximum extent permitted by law:

  • mTik_Ops is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, goodwill, or business opportunity.
  • mTik_Ops total aggregate liability for claims arising out of or related to the Services will not exceed the amounts paid by you to mTik_Ops for the affected Services during the twelve (12) months before the event giving rise to liability.

Indemnification

You agree to defend, indemnify, and hold harmless mTik_Ops and its affiliates, officers, employees, contractors, and agents from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use or misuse of the Services.
  • Your violation of these Terms or applicable law.
  • Your Customer Data or your infringement/misappropriation of third-party rights.
  • Acts or omissions of your users, employees, team members, contractors, or subscribers.

Governing Law and Disputes

These Terms are governed by the law specified in your applicable service order or master agreement.
If none is specified, disputes will be resolved in the competent courts of mTik_Ops principal place of business, unless mandatory law requires otherwise.

Changes to Terms

We may update these Terms from time to time. Material changes may be communicated via platform notice, website posting, or email. Continued use after the effective date of updated Terms constitutes acceptance.
